Online T-Shirt.com.au reserves the right to refuse any order at its discretion.
Copyrights
1. The customer will indemnify and hold harmless our company from any loss, expense, and damages arising from violation of copyright or trademark laws from the illegal use of images, photographs, slogans, trademarks, or graphical work supplied and approved by the customer.
Printing and finishing
1. As print runs are generally ganged up, print colours may vary from print to reprint, from stock to stock and from job to job.
Delivery
1. All goods are sold ‘ex-factory’ and any delivery cost is incurred as your agent.
2. Orders received are generally ready for dispatch within 5-7 working days. On average it takes 5 days from the order date to get jobs ready.
3. Online T-Shirt.com.au will not be held liable for any losses incurred by customers as a result of jobs that are delayed for any reason either in production or on delivery.
4. If goods are delivered in a damaged condition, it is your responsibility to note this on the delivery docket with the courier. Any damages not signed for will not lead to reprint at our cost.
Collection
1. The customer must collect the goods from Online T-Shirt.com.au premises upon being notified by Online T-Shirt.com.au that the goods are ready for collection
2. If Online T-Shirt.com.au agrees to deliver the goods the customer shall bear all freight costs and charges incurred by such delivery
Responsibility to insure
1. Online T-Shirt.com.au has no obligation to insure any property of the customer in Online T-Shirt.com.au possession.
2. If a customer requests Online T-Shirt.com.au to arrange insurance, the customer must pay the cost of the insurance in full upon request.
Non Payment
1. Retention of ownership until the customer has paid all sums outstanding in relation to the goods
2. Title in the goods shall not pass from Online T-Shirt.com.au to the customer
3. If the goods are in the customer’s possession, the customer shall hold the goods as trustee for Online T-Shirt.com.au and must store the goods so that they are clearly identifiable as the property of Online T-Shirt.com.au.
General lien
1. Online T-Shirt.com.au shall, in respect of all sums owed by the customer to Online T-Shirt.com.au hereunder, have a general lien on all property of the customer in Online T-Shirt.com.au possession and may, after 14 days’ notice to the customer, sell that property and apply the proceeds (net of any sale costs) in satisfaction of all or any part of the sums owed.
2. In the event that any of the customer’s property held by Online T-Shirt.com.au as aforesaid enjoys copyright protection in favour of the customer hereby grants to Online T-Shirt.com.au a license to exercise the rights conferred on Online T-Shirt.com.au under this clause
Printing defects
1. All our printed products are ‘print on demand’ i.e they are printed to order for each individual customer. If you send us a ‘ready to print’ document then we will print it as is without any alterations. We check all orders before they are dispatched, but if you find there is a fault with your order due to misprinting or damage, please return the faulty order and we will reprint it. However, if the problem is due to artwork issues, Online T-Shirt.com.au will not reprint the job as it is your responsibility to supply print ready artwork.
2. Any queries regarding printing and finishing errors must be made within 7 working days of receipt of goods. Sample of defective product must be sent to Online T-Shirt.com.au for analysing the nature of defect
Rejection
1. The customer may only reject the goods if they do not comply with the customer’s instructions and if different from final proof sent by Online T-Shirt.com.au.
2. If the customer wishes to reject the goods the customer must notify Online T-Shirt.com.au of the rejection and reasons thereof.
3. If Online T-Shirt.com.au delivered the goods to the customer’s premises-within 7 days of delivery (or such other time as is mutually agreed);
4. . Otherwise – within 7 days of notification that the goods are ready for collection (or such other time as is mutually agreed)
Risk
1. The risk in the goods passes to the customer:
2. If Online T-Shirt.com.au delivers the goods to the customer’s premises – at time of delivery
3. Otherwise-at the time Online T-Shirt.com.au. notifies the customer that the goods are ready for collection
4. If the customer is entitled to reject the goods and rejects the goods in accordance with these terms and conditions, risk reverts to PRINT 48 at the time the customer notifies PRINT 48 that the goods are rejected.
Freight Policy
1. Online T-Shirt.com.au agrees to deliver your printing order hereinafter referred to as “order” as your agent to the address specified by you.
Online T-Shirt.com.au ceases upon loading of your order onto a courier. You can insure against loss and damage. There is fee payable for this. Otherwise you will have to bear the loss.
Upon dispatch, Online T-Shirt.com.au will email details to your registered email including name of Courier Company, phone number of Courier Company, consignment number and website address of the courier so you can track your shipment. If your order is on Online T-Shirt.com.au Courier, then you can contact Online T-Shirt.com.au.
Freight quoted on our website is based on standard next day delivery including for Sydney locations. Extra freight handling charges will be payable for delivery to multi-storey buildings, CBD and other non-readily accessible areas. In general 10 minutes is allowed for delivery. If it takes longer than that, then extra time will be billed to you. Freight is always an estimate. Absolute freight amount can only be determined after the delivery has been made.
If you have paid online for your order including estimated freight, you may be required to pay an additional amount for change in courier type, delays in effecting delivery due to inconvenient locations, no one present to receive order and for any other unforeseen circumstances.
You must clearly tell us where the order is to be left in case no one is at the delivery address. Additional costs will apply for taking your order back to Courier Depot and redelivering at a later stage. It is therefore critical that someone is there to accept the delivery.
Using our Online T-Shirt.com.au Services and Website:
In consideration of the promises and obligations given and assumed herein, and intending to be legally bound, these Terms of Use provide as follows.
1. Eligibility children under 18
  Online T-Shirt.com.au will only knowingly provide products or services to persons who can lawfully enter into and form contracts under applicable law. If you are under the age of 18, but at least 13 years of age, you may order products or services only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. Children under the age of 13 may view the Website but MAY NOT order products or service.
2. Definitions and Interpretation
  In these Terms of Use, unless the context indicates a contrary intention: Intellectual Property Rights means all industrial, commercial and intellectual property rights (including equivalent, neighboring or proximate rights anywhere in the world that currently exist or are recognised in the future).
  A person means any form of legal entity as well as any quasi-legal entity.
  A User means any person using the website and/or services provided by The Online T-Shirt.com.au
  A reference to any document, material, information or data includes that document, material, information and data howsoever stored, recorded or embodied, including in any electronic or digital media or otherwise.
  The word includes in any form is not a word of limitation.

  In consideration of the promises and obligations given and assumed herein, and intending to be legally bound, these Terms of Use provide as follows.

  Users are and shall be wholly and exclusively responsible, at their own cost, for: All telecommunications lines, modems, communication controllers, routers, multiplexers, terminals and all other equipment, hardware and software necessary to access and use the Website and services; The use that it makes of the Website , including any article, material, literary or artistic work, design or other matter that they author, invent, create, develop or produce; Complying with all laws, regulations and rules in the uses country or jurisdiction Complying with any recommendations or guidelines issued by Online T-Shirt.com.au with respect to the use of the Website and/or services and Ensuring that all electronic or other media it uses in connection or in conjunction with the Website and the services provided complies with these Terms of Use and all applicable laws, regulations and rules.
